Matt Glover was pleased to serve as local counsel in a product liability lawsuit filed in Tuscaloosa County by attorneys from Mobile and Montgomery. The product made the basis for the suit was a tractor that did not have a Falling Object Protection System (FOPS). The complaint alleged a FOPS would have prevented the death of Matt’s client’s decedent. Count 1 of the complaint was brought pursuant to the Alabama Extended Manufacturer’s Liability Doctrine and alleged that the tractor was defective and unreasonably dangerous by design, by manufacture, and by failure to warn, or adequately warn, ultimate users and consumers. There were also counts for negligence or wantonness and negligent misrepresentation.
