Prince Glover Hayes Associate, Coe Baxter, Settles Lawsuit in Jefferson County, Alabama

PGH associate, Coe Baxter, recently settled a lawsuit arising out of a car accident in Jefferson County, Alabama. Coe filed suit in the Circuit Court of Jefferson County (Birmingham Division) alleging his client was injured due to the negligence and/or wantonness of the defendant when he rear-ended the vehicle being driven by his client. His client’s husband was also an occupant of the car. Coe included a count in the complaint for a claim for uninsured/underinsured motorist coverage. A lawsuit was necessary when Coe was only offered $9,000 to settle the case. After extensive written discovery and several depositions, Coe was able to negotiate a favorable settlement and thus spare his client the burden of a jury trial. The adverse driver’s insurer paid $100,000 to settle the case and Coe’s client’s insurer paid $20,000 to settle. The $100,000 represented the policy limits of the defendant’s coverage. This amount, however, was not enough to make Coe’s client whole, so he was able to obtain the additional amount from the underinsured motorist benefits.
