PGH associate, Coe Baxter, recently filed a lawsuit in the Circuit Court of Tuscaloosa County. The lawsuit involves a car wreck that occurred on Rice Mile Road, NE in Tuscaloosa. Coe’s client was traveling in the southbound lane and the adverse driver, traveling in the northbound lane, made a left turn across the intersection colliding with Coe’s client. Coe also named as a party defendant the owner of the adverse driver’s vehicle. Count 1 of the complaint alleges negligence on the part of the adverse driver and further alleges the owner’s vicarious liability for the conduct of the driver. Count 2 alleges the owner negligently entrusted the vehicle to the adverse driver and as a proximate result of that entrustment, Coe’s client was injured. Count 3 alleges the owner negligently hired, supervised and/or retained the adverse driver and that resulted in the injuries to Coe’s client. Coe demanded that this case be tried by a jury. Along with the complaint, Coe filed interrogatories and requests for production to both defendants.
