Robert Prince, Prince Glover Hayes Partner, Settles Car Accident Lawsuit

PGH partner, Bob Prince, recently settled a lawsuit involving a car collision. Bob’s client was seriously injured when the adverse driver left the roadway and crashed into Bob’s client’s car which was parked on the side of the road as part of the work he was performing that day. Bob’s client was standing on the driver’s side of his car and when the adverse driver collided with his car, it, in turn, hit Bob’s client. It was learned, during Bob’s investigation of the facts of the collision, that the adverse driver was driving under the influence of alcohol. Bob made a demand for policy limits on the adverse driver’s insurance company and was able to settle with the adverse for $25,000 limits. Bob also made a claim on his client’s underinsured motorist coverage and “stacked” coverage resulting in a $75,000 settlement with his client’s insurer. In Alabama, injured persons can “stack” uninsured/underinsured motorist coverage. Further, in Alabama, the injured party can stack two additional coverages on top of the primary coverage on claims involving single multiple vehicle policies. For example, if an injured person has a single multiple vehicle insurance policy with uninsured/underinsured motorist limits of $50,000 per person insuring three vehicles, by “stacking” the coverage from the insured’s other vehicles there would be $150,000 in benefits available.
