Prince Glover Hayes Partners Josh Hayes and Blake Williams Settle Workplace Injury Lawsuit

Josh Hayes and Blake Williams, PGH partners, recently settled a workplace injury lawsuit that was filed in Jefferson County, Alabama. The settlement amount is confidential. Our client was injured while he was working at a lumber processing plant. He was not properly trained on how to operate the machinery and, unfortunately, the machinery he was using on the day of his injury did not have proper guards to protect users. When our client tried to steady a piece of lumber traveling down a conveyor belt, his gloved hand was knocked into a chain and sprocket drive system. As his hand was being sucked further into the drive system, our client was able to use his strength to pull his gloved hand free. In the process, a portion of one of his fingers was ripped off.
Josh and Blake filed the lawsuit against the plant owner for 1) failing to guard the drive system, and 2) failing to properly train the users of the machinery. Josh and Blake hired an expert to inspect the machinery and evaluate it for potential flaws in the guarding of what are referred to as “nip” points, those areas that expose users to danger or harm. After our expert completed his work and Josh and Blake continued with the necessary preparations to get the case ready for a trial. During that process, we were able to reach a settlement agreement that our client was pleased with to resolve his claims.
